Looking for an Expungement?
Call Our Chesapeake Criminal Defense Lawyer to Begin
Being charged with a crime is a stressful time for anyone, and the knowledge
of what a conviction can bring later on in life can make it even worse.
You can be very limited in terms of schooling or employment with a criminal
record. However, there may be hope for you through an expungement in which
your criminal record is effectively wiped clean.
J. Bouchard Law, our Chesapeake
criminal defense attorney can work to have your record expunged and set you free from the
potentially ruinous consequences of an arrest. As a former prosecutor,
Attorney Bouchard understands how the criminal justice system and expungements
work. We can walk you through each stage of the process to get your record
cleared and protect your future.
Do I qualify for an expungement?
Expungement only applies to certain situations—if you have been found
innocent of your charge, if a nolle prosequi is taken, the charge is dismissed,
an absolute pardon is granted, or someone else unlawfully used your name
and been convicted of a crime, you can apply for expungement.
In such cases, an expungement can free you up for the following opportunities:
- Federal assistance
- Firearm rights
If you qualify for expungement, you need to file a petition and have a
copy of the warrant or indictment with the court where the case took place.
The court will send a copy to the commonwealth where you filed and their
attorney will respond to the petition.
During your hearing, if the court determines you merit an expungement,
it can enter an order to have your police and court record expunged. In
effect, you will be able to legally deny that you were ever arrested to
potential employers and others in the future.
